The purchase of products on the Vascocaffe.it site is governed by these general sales conditions (hereinafter referred to as "General Terms of Sale"), which you must view before concluding a purchase order.
Vascocaffe.it is owned by the company BVA DISTRIBUZIONE DI BALICE VASCO AMEDEO, with registered office in Molfetta (BA), Via Pansini Legnami, 9 - Z. I. ASI.
These General Terms and Conditions of Sale apply to all purchase orders placed on the Vascocaffe.it website in the manner and terms indicated in the following point "How to conclude a purchase order".
RECIPIENTS OF COMMERCIAL OFFER
Vascocaffe.it offers products for sale to "consumers" and professional subjects. The sales conditions that refer to the regulations of the Consumer Code (B2C) apply only to purchases made by consumers. As far as professional subjects are concerned, the ordinary provisions of the Civil Code and of the regulations on distance commerce by telematics between professionals (B2B) are applied. "Consumer" means the natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity performed.
OBJECT OF THE CONTRACT
These General Terms and Conditions of Sale have as their object the purchase of clothing and accessories for men, carried out remotely via a telematic network ("internet") between the seller and the recipient of the commercial offer.
PRICES OF PRODUCTS
All prices are inclusive of VAT.
Prices do not include shipping and / or insurance costs that can still be viewed when the order is concluded and before it is sent. Prices can be changed at any time, without notice. The prices of the products sold on Vascocaffe.it may be updated and may differ depending on the state in which the relative product is to be sent. With reference to shipments to non-European countries, it is possible that some administrative charges, such as for example, customs duties, cannot reasonably be calculated in advance; in this case, these administrative charges may still be charged to the customer. Therefore, we ask you to verify the final price before concluding a purchase order.
HOW TO CONCLUDE A PURCHASE ORDER
In order to place a purchase order on the Vascocaffe.it site, the user must have a valid e-mail address, as well as the legal requirements to enter into the relevant purchase contract. You can place a purchase order by following this procedure:
- After choosing one or more products to buy, click on "Add to cart".
- Complete the order form following the instructions. The order form will indicate the essential characteristics of the products ordered, the relative price (including all taxes or duties, where these can be determined), delivery costs, payment methods and product delivery, an express link to the " Returns ”in which the methods, times and conditions for exercising the right of withdrawal and for the return of the purchased products are indicated.
- At this point, to send the order form to Vascocaffe.it, click on "Buy". When Vascocaffe.it receives the order form you sent, the purchase proposal will be considered forwarded. - Following the receipt of the order form, Vascocaffe.it reserves the right to send a receipt via e-mail of the order, which will contain the information already indicated in the order form (essential characteristics of the products, price, delivery costs, payment and delivery methods, link to the "Returns" section) and will execute the Purchase Order.
- The order will be stored in the Vascocaffe.it database and can be viewed at any time by accessing the "Account" by entering the data through the "Login" function.
The purchase contract for one or more products will be considered concluded only when Vascocaffe.it communicates to the customer the shipment of the relative product. Vascocaffe.it reserves the right not to execute purchase orders with missing or incorrect data, or that do not provide a guarantee of solvency. In these cases, the user will be informed by e-mail of the non-execution of the order and the related reasons. Vascocaffe.it also reserves the right not to execute purchase orders if the products are found to be unavailable for any reason and even temporarily. In this case, within 3 (three) days of receipt of the order, Vascocaffe.it will inform the user via e-mail that the product is not available and will refund any amount already paid.
If the ordered products are available and Vascocaffe.it intends to accept the purchase order, Vascocaffe.it undertakes to process the order and ship the products within 2 (two) days. Vascocaffe.it is exempt from any liability for delays in delivery of products that are independent of the conduct of Vascocaffe.it, for example because they are dependent on the service provided by the courier that handles the delivery.
The various payment methods for the price of the products and the relative delivery costs are indicated on the order form. These methods include Credit Cards and PayPal, Bank Transfer and Cash on Delivery. The price indicated on the order form for the purchase of products and the related delivery costs will be charged to the customer once the purchase order is concluded. If the customer makes the payment by credit card, Vascocaffe.it guarantees that the management of the payment procedure will be managed by a primary payment gateway without Vascocaffe.it coming into possession of any bank or financial data. The credit card information will be used exclusively to be able to carry out the purchase procedure, to credit the reimbursement if the customer were to return the products by virtue of the right of withdrawal, or if it was necessary to report any commission to the competent authorities of frauds occurred on the Vascocaffe.it site, moreover, in no case Vascocaffe.it will keep data concerning such information. If the customer makes the payment by Bank Transfer / Post Office in advance the order fulfillment procedure will be started once the amount of the entire order has been credited to the C / C payable to Vascocaffe.it (about 1-5 working days). The purpose of the transfer must contain: The date and the order number - Name and surname of the ordering party. Upon confirmation of the order, the customer will receive an email with all the details to make the transfer.
If the customer makes the payment on delivery, the amount of € 6.00 will be due as a service offered for payment to be made directly to the delivery exclusively in cash.
COD orders are not accepted for orders over € 999.00 and bank or bank draft checks are not allowed.
SHIPPING: TIMES AND DELIVERY
Except in the case of partial or total unavailability of the products, if Vascocaffe.it decides to execute the purchase order, Vascocaffe.it undertakes to deliver the product or products to the courier no later than 2 (two ) days from the date of forwarding the purchase order. Accepted orders will be shipped and delivered by courier selected by Vascocaffe.it. To know all the details on the shipping and delivery methods of the products, it is necessary to consult the "Delivery & Transport" section. Please read the contents of the "Delivery & Transport" section because it is an integral and substantial part of these General Sales Conditions and, therefore, is considered to be known and accepted in full at the time the order form is sent. Vascocaffe.it is exempt from any liability for delays in delivery of products that are independent of the conduct of Vascocaffe.it, for example because they are dependent on the service provided by the courier that handles the delivery (eg strikes, etc.).
RIGHT OF WITHDRAWAL
The customer who is a consumer has the right to withdraw from the purchase contract stipulated with BVA DISTRIBUZIONE by Balice Vasco Amedeo without penalty and without giving any reasons. The withdrawal period expires after 14 (fourteen) days from the date on which the customer or a third party other than the courier and the designated customer acquire physical possession of the products.
In case of withdrawal from this contract, all the payments made to Vascocaffe.it will be refunded to the customer, including delivery costs (except for the additional costs deriving from the customer's choice of a different type of delivery from the standard one offered by BVA DISTRIBUZIONE of Balice Vasco Amedeo), without undue delay and in any case not later than 14 (fourteen) days from the day on which Vascocaffe.it receives the goods returned or the customer has unequivocally demonstrated to have returned the goods , depending on which situation occurs first.
Returned products must be sent to Vascocaffe.it without undue delay and in any case within 14 (days) from the date on which the customer has notified Vascocaffe.it of his intention to withdraw. The date of postal delivery or delivery to the courier will apply. The shipping costs of the returned products will be fully borne by the customer. Refunds will be made using the same payment method used for the initial transaction. The customer will be solely responsible for the decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the products. It is specified that:
1. It is absolutely forbidden to remove seals or labels;
2. The products must be shipped healthy, clean, intact and complete, including any accessories;
3. It is forbidden to use the products for "trial" purposes before making the return.
4. The right of withdrawal does not apply to sealed products opened by the consumer, nor to sealed goods that do not lend themselves to being returned for hygienic reasons or connected to the protection of health that have been opened after delivery.
5. The right of withdrawal is reserved exclusively for consumers (natural persons who purchase goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore it cannot be exercised by legal persons and natural persons acting for purposes related to professional activity possibly carried out.
In the event that the customer does not comply with the terms for the right of withdrawal and return indicated above, or the provisions referred to in points 1), 2), 3), 4) and 5), Vascocaffe.it will not be required to refund the purchase price of the products to the customer. In the event that the customer has returned these products, he may ask Vascocaffe.it to send back the same items purchased, but with return costs fully charged to the customer who has violated the rules on the right of withdrawal. Please refer to the "Exchanges and Returns" section for further details on the methods, terms and conditions for exercising the right of withdrawal. Please note that the content of the "Returns" section is an integral and substantial part of these General Sales Conditions and is considered to be known and accepted in full by the customer at the time the order form is sent.
